The Attorney General claims that the reasons Brown uses to show business necessity in relation to the claim of violation of G. L. c. 151B, § 4 (6), are invalid because they are unlawful under G. L. c. 151B, § 4 (10). Since we conclude that it has not yet been established that Brown’s policies were unlawful under § 4 (10), we cannot uphold a summary judgment under § 4 (6) which relies on a violation of § 4 (10) . Judgment reversed. 1
