The judge awarded the tenants attorney’s fees of $2,950 under G. L. c. 93A, § 9 (4). In reaching this figure the judge excluded time spent by the tenants’ counsel in connection with several defaults against the landlord and Mishara and a related motion by the tenants to postpone the trial. The judge found that the defendants’ failure to appear at a conciliation hearing and for trial was the result of improperly addressed notices sent by the clerk’s office. On each occasion the defendants were defaulted and their later motions (in the first case to set aside entry of default, in the second to vacate a judgment entered against them) were granted.
